What are the two parts of this Act?

  • Emergency Paid Sick Leave Act, and
  • Emergency Family and Medical Leave Expansion Act

 What does the Emergency Paid Sick Leave Act provide?

  • This act allows an employee who is unable to work, or telework, to take paid sick leave for the following specified reasons:
  • Subject to a Federal, State, or local quarantine or isolation order related to COVID-19
  • Advised by a health care provider to self-quarantine due to COVID-19 concerns
  • Experiencing COVID-19 symptoms and seeking medical diagnosis
  • Caring for an individual, not limited to just family member, subject to quarantine or isolation order or advised by a health care provider to self-quarantine due to COVID-19 concerns
  • Providing care for his/her child whose school or childcare provider is closed due to the COVID-19 health emergency

Am I eligible for Emergency Paid Sick Leave Act?

  • Full-time employees are eligible for up to 80 hours of additional fully paid sick leave for the following qualifying reasons: you are subject to a quarantine or isolation order related to COVID-19, your health care provider advised you to self-quarantine due to COVID-19, or you are experiencing COVID-19 symptoms and seeking medical diagnosis. The fully paid sick leave is limited to $511 per day and $5,110 total. The 80 hours are prorated for less than full-time employees.
  • Full-time employees are eligible for up to 80 hours of additional paid sick leave at 2/3rd pay for the following qualifying reasons: you are caring for an individual subject to quarantine or isolation order or advised by a health care provider to self-quarantine due to COVID-19, or you are caring for your child whose school or childcare provider is closed due to COVID-19. The 2/3rd pay is limited to $200 per day and $2,000 total. The 80 hours are prorated for less than full-time employees.
  • The 80 hours is applied before any other accrued leave in your leave bank.

What does the Emergency Family and Medical Leave Expansion Act provide?

It temporarily expands FMLA and applies to employees who are unable to work, or work remotely, due to childcare or school closure. This is the only qualifying reason for this leave. This leave is up to 12 workweeks and is inclusive of any other FMLA usage during the 12 month designation period.

Am I eligible for Emergency Family and Medical Leave Expansion Act?

Both full time and part-time employees are eligible, if you have worked for LBCC at least 30 days prior to needing to take this leave.

 Will I be paid if I take Emergency Family and Medical Leave?

  • The first 10 days of leave are unpaid but an employee has two options to maintain their salary during this period. An employee may request to use the 80 hours of Emergency Paid Sick Leave or an employee may substitute any accrued paid leave.
  • After the first 10 days, an employee will be paid at 2/3rd of his/her regular rate of pay. This additional 2/3rd pay is limited to $200 per day or $10,000 total for the remaining 10 weeks.
